564 Years of Injustice and the Downfall of the Native American Indians

In 1452, Pope Nicholas V of the Roman Catholic Church, gave the first “bull Romanus Pontifex” (“Doctrine of Discovery”) to King Alfonso V of Portugal.

This papal document, gave King Alfonso V the legal & religious right, to declare war against all non-Christians in the whole world. The Portuguese king could capture, vanquish, enslave the enemies of Christ, and he could take all of their personal & real property.

When Christopher Columbus discovered America, he was given the “bull Romanus Pontifex” or “Doctrine of Discovery” to take possession of any lands that he discovered, that was not under the dominion of any Christian rulers.

On May 3, 1493, when Columbus returned to Europe, Pope Alexander VI issued the “bull Inter Cetera”. This papal document granted Spain (King Ferdinand & Queen Isabella), the legal & religious right to own all the lands that Columbus discovered, and any lands that might be discovered in the future.

The Christian “Law of Nations” gave all Christian nations the divine right, based on the Bible, to claim absolute legal title and ultimate authority over any non-Christian people and their lands.

In 1823, the “Christian Doctrine of Discovery” was adopted by the US Supreme Court, in Johnson versus McIntosh (8 Wheat. 543). Chief Justice John Marshall wrote the unanimous court decision. The Christian European nations had assumed the “ultimate dominion” over the lands of America during the “Age of Discovery”. The American Indians had lost “their rights to complete sovereignty, as independent nations” and only retained the “right of occupancy” in their lands.

Chief Justice John Marshall stated that the United States, upon winning its independence in 1776, became a successor nation to the “right of discovery” and acquired the “power of dominion” from Great Britain. Marshall defined the “principle of discovery” as, discovery gave title to the government, against all other European governments. Marshall cited the “English Charter” issued to explorer John Cabot, in order to document England’s “complete recognition” of the “Doctrine of Discovery”.

Marshall noted that Cabot was authorized to take possession of lands, notwithstanding the occupancy of the natives, who were heathens. Under the “Law of Nations” it was permissible to ignore the basic rights of the “indigenous heathens”.

The “Doctrine of Discovery” was cited in 2005, in City of Sherrill versus Oneida Indian Nation of NY.

The US Supreme Court, in Cherokee Nation versus Georgia (1831), stated that the Indian nations, were not “fully sovereign nations”. They were “domestic dependent nations” subject to the federal government’s legislative authority, known as “plenary power”.

The US “plenary powers” over the American Indians, have circumvented all of the 500+ Indian Treaties. Indian ancestral homelands, east of the Mississippi River, were taken away by the “Indian Removal Act of 1835”. The US Congressional Statute, known as the “General Allotment Act of 1835” took 90 million acres of American Indian lands. The Black Hills, belonging to the Great Sioux nation, lost their exclusive & absolute possessions of their lands, in violation of the 1868 Treaty of Fort Laramie. The Western Shoshone Nation lost 24 million acres of land. The Western Shoshone Nation refused to sell or accept $26 million dollars. The Secretary of the Interior accepted $26 million dollars and the Federal Government extinguished the Western Shoshone’s title to their lands.

The current Keystone XL, is a current example of American Indian Lands, being taken away by Federal Legislation and physical force.
